For Drivers’ Licenses Came Within
One Vote of Passing on Senate Floor
An amendment offered by Senator David Brinkley (R-Frederick & Carroll counties) to require “legal presence” for Maryland drivers came within one vote of passing (23-24 vote) on the Senate floor today. The amendment would have prohibited the Motor Vehicle Administration from issuing a driver’s license to an individual who cannot provide documentation certifying that the individual is a U.S. citizen or is lawfully present in the United States.
“Maryland’s status as a magnet for illegal aliens to apply for drivers licenses without proof of legal presence has been detrimental to the safety of our citizens,” said Senator Brinkley in testimony before the Senate Judicial Proceedings Committee last month. “We can no longer afford to serve as the primary location on the East Coast that offers a ‘quick-stop, drive-thru’ location for issuing driver’s licenses without proof of legal presence.”
The issue of requiring proof of legal presence has been a hotly debated topic in the General Assembly over the past three years. Maryland is one of only five states in the nation that does not require proof of lawful presence when an individual applies for a driver’s license.
At the beginning of this year’s session, Governor O’Malley proposed that the MVA create a two-tiered driver’s license system as a way to comply with the federal REAL ID act while still maintaining a secondary system for issuing licenses to illegal immigrants. That plan was opposed by many citizens and groups advocating for strong homeland security protections and was eventually scuttled by the Administration.
The Brinkley amendment was offered on the third reading vote for HB 478 – a departmental bill that would alter provisions for commercial driver’s licenses to be in compliance with federal transportation laws.
Senator Brinkley offered the following conclusion on the floor: “Unfortunately, one vote would have made the difference on this amendment. The citizens of Maryland lost a major opportunity today to resolve, once and for all, that Maryland will no longer be a haven state for illegal activity.”
